Welcome to Pachinko!

Your use of the Pachinko application for macOS and iOS (the "Application") is governed by this legal agreement (the "Terms"). The Application is provided by Babel, located in Washington State, USA.

By using the Application, you are agreeing to these Terms. Please read them carefully.

The Application is available to you if you are 18 years of age or older. By using the Application, you represent and warrant that you are at least 18 years old.

Using our Application

You must follow any policies made available to you within the Application. You agree to use the Application only for purposes as permitted by these Terms.

Using our Application does not give you any legal right, title, or interest in our Application or the content you access. You may not assign (or grant a sub-license of) your rights to use the Application, or otherwise transfer any part of your rights to use the Application.

The Application, including the software used to implement the Application, is protected by copyright, trademark, applicable intellectual property and other laws. These Terms do not grant you the right to use any trademarks, branding, or logos used in our Application.

Don't misuse our Application. For example, you may not: a) reverse engineer, decompile or otherwise attempt to extract the source code of the Application, unless this is required by law; b) attempt to disable or circumvent any security mechanisms used by the Application; c) use the Application to distribute malware; d) use the Application in any way that violates applicable laws or regulations.

Your Content

All information you store in the Application using iCloud is your responsibility. Babel does not access, use, or store any of your user content (notes, tasks, or other data you create in Pachinko).

You are solely responsible for securing and backing up your content. Babel is not responsible or liable for the deletion, corruption, or failure to store any content maintained or transmitted through your use of the Application, regardless of cause — including software bugs, iCloud sync failures, operating system issues, or any other circumstance. We strongly encourage you to use Pachinko's built-in Backup feature regularly to protect your data.

Subscription and Payment

Pachinko offers a free tier and a paid Pro subscription. Pro subscriptions are billed monthly through LemonSqueezy, our payment processor.

Pachinko offers a 7-day free trial of Pro features. A standalone trial key expires after 7 days with no charge. A monthly subscription key includes a 7-day free trial period, after which your subscription will automatically begin and you will be billed monthly. If you cancel during the trial period, you will not be charged.

All sales are final. We do not offer refunds for any billing period that has already begun. You may cancel your subscription at any time through your LemonSqueezy account. Upon cancellation, your Pro features will remain active until the end of your current billing period, after which your account will revert to the free tier.

AI-Generated Content

Pachinko integrates with third-party AI services (such as OpenAI and Anthropic) to provide features including chat, runners, and content generation. You may connect these services using your own API key or account credentials.

AI-generated content may be inaccurate, incomplete, or misleading. Babel does not guarantee the accuracy, reliability, or suitability of any AI-generated output. You are solely responsible for reviewing, verifying, and evaluating all AI-generated content before relying on it or taking any action based on it.

Babel is not liable for any decisions, actions, losses, or damages arising from your use of or reliance on AI-generated content.

Third-Party AI Services

Pachinko connects to third-party AI providers (such as OpenAI's ChatGPT and Anthropic's Claude) to power its AI features. Your use of these services through Pachinko is subject to the respective terms and privacy policies of those providers. Babel is not responsible for the availability, performance, or data handling practices of any third-party AI service.

You are responsible for complying with the terms of service of any third-party AI provider you connect to Pachinko, including any usage limits, content policies, or data processing agreements. If your use of AI features through Pachinko results in the suspension, termination, or restriction of your account with any third-party AI provider, Babel bears no responsibility or liability for such actions taken by the provider.

Privacy

Your use of the Application is subject to our Privacy Policy, which describes what limited data we collect and how it is handled. By using the Application, you agree to the terms outlined in our Privacy Policy.

About Software in our Application

The Application may from time to time automatically download and install updates. These updates are designed to improve, enhance and further develop the Application and may take the form of bug fixes, enhanced functions, or entirely new versions of the Software.

Pachinko gives you a personal, non-assignable, non-exclusive, limited license to use the Application. Your license is tied to your license key and may not be shared, transferred, or used by any other person. The license is for the sole purpose of enabling you to use our Application in the manner permitted in these Terms.

Modifying and Terminating our Application

We are constantly modifying and improving our Application over time. We may add or remove features or functionalities, and we may temporarily suspend or discontinue the Application altogether.

You can stop using the Application at any time. Babel may also stop providing the Application to you at any time, with or without cause, and with or without notice.

Exclusion of Warranties

NOTHING IN THESE TERMS SHALL EXCLUDE WARRANTIES WHICH MAY NOT BE LAWFULLY EXCLUDED BY APPLICABLE LAW.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE APPLICATION IS AT YOUR SOLE RISK AND THAT THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE." BABEL MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

NOTHING IN THESE TERMS SHALL LIMIT BABEL'S LIABILITY FOR LOSSES WHICH MAY NOT BE LAWFULLY LIMITED BY APPLICABLE LAW.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT BABEL SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES WHICH MAY BE INCURRED BY YOU, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APPLICATION.

IN ANY CASE, BABEL'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APPLICATION SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO BABEL IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Babel and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with: a) your use of the Application; b) your violation of these Terms; c) your violation of any rights of any third party; or d) any content you create, store, or transmit through the Application.

Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

You and Babel agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Application shall be resolved through binding arbitration, rather than in court, except that either party may bring claims in small claims court if eligible.

Arbitration shall be conducted by a single arbitrator in King County, Washington (Eastside/Bellevue area) under the rules of the American Arbitration Association (AAA). The arbitrator's decision shall be final and binding.

YOU AND BABEL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

If this class action waiver is found to be unenforceable, then the entirety of this arbitration section shall be null and void, and the dispute shall proceed in the courts of King County, Washington.

Export Control

You may not use or export the Application except as authorized by United States law and the laws of the jurisdiction in which the Application was obtained. The Application may not be exported or re-exported to any U.S.-embargoed countries or to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce's Denied Persons List or Entity List.

Force Majeure

Babel shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond Babel's reasonable control, including but not limited to: outages or changes to third-party services (such as Apple iCloud, OpenAI, Anthropic, or LemonSqueezy), internet service disruptions, natural disasters, acts of government, or any other force majeure event.

Waiver

The failure of Babel to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Babel.

About these Terms

Please note that the Terms of Service may change from time to time. We will post notice of modifications on our website. You understand and agree that if you use the Application after the date on which the Terms have changed, Babel will treat your use of the Application as acceptance of the updated Terms.

This agreement will be governed by and construed in accordance with the laws of Washington State, USA, without regard to its conflict of law provisions.

These Terms constitute the entire agreement between you and Babel regarding the Application and supersede all prior agreements, understandings, and communications, whether written or oral.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
